TEXAS LAW FIRM PASSES OUT $100 MILLION IN BONUSES

AUSTIN, TEX., AUG. 21 -- People joke about lawyers, sometimes out of anger, sometimes out of envy, but usually the legal eagles get the last laugh. That often happens on payday, especially the type enjoyed today at Vinson & Elkins, one of the largest and most powerful law firms in Texas. On this day, $100 million in bonuses was distributed to 490 employees, from senior partners to mail clerks.
"It was a very good day for us," said managing partner J. Evans Attwell, a master of understatement.
The $100 million was the final share of a mother lode of contingency fees earned by the law firm for representing a consortium of companies that wanted to build a coal-slurry pipeline from Wyoming to Texas.
When the consortium, ETSI Pipeline Project, was thwarted, it sued five railroad companies, charging that they had disrupted, delayed and destroyed the project through administrative maneuvers and by refusing to allow rights of way.
Vinson & Elkins took the case on a one-third contingency fee, meaning that if it won, it would receive one-third of the settlement and, if it lost, it would get nothing. For six years, the firm worked for nothing, in a sense, doing an estimated $25 million worth of work before the railroads started to settle.
Four settled before the issue reached federal court, and the fifth, Santa Fe Railway Co., fought and lost in court, then settled instead of appealing. It was the Santa Fe portion of the settlement that appeared in the firm's paychecks today.
Overall, by Attwell's estimate, the firm received slightly less than $200 million from a settlement that neared $650 million for the winning consortium, which included Panhandle Eastern Corp., the Bechtel Group, Enron Corp. and K N Energy Inc.
Considering that Texas was the state in which Pennzoil, represented by lawyer Joe Jamail, won a $3 billion settlement against Texaco, the railroad case seems modest. But it is the largest settlement in Vinson & Elkins's history, "a once-in-a-lifetime" windfall for any firm, Attwell said.
Some employees received more than others, according to a formula worked out by the firm's management committee. Attwell would not discuss specific bonuses but acknowledged that the distribution process included secretaries and mail clerks. He also said a few employees became instant millionaires.
Senior partners and those associated with the case got the most out of the deal. "There were a few parties around here today," said Attwell, who added that "it would be safe to say" even more parties were held outside the firm's Houston office.
If the partners at Vinson & Elkins had a good day, even theirs paled in comparison with the bonanza reaped by lawyer Gilbert "Buddy" Low of Beaumont. It was his good fortune to be the local attorney chosen by Vinson & Elkins to be on the legal team when it filed the civil lawsuit before U.S. District Judge Robert Parker in the state's southern district in Beaumont.
The suit was filed there rather than Houston because its docket is lighter. Traditionally, the leading law firms add a local lawyer to their team in such cases.
For his role, which largely consisted of taking depositions from the Santa Fe board chairman in Chicago and the Santa Fe president at a resort in Colorado Springs, Low took in $13 million. He has invested most of it and spent some on a two-week vacation through Europe with 12 relatives and friends.

Kinder Morgan’s SFPP system consists of the North Line, which consists of approximately 864 miles of trunk pipeline in five segments that transport products from Richmond and Concord, Calif., to Brisbane, Sacramento, Chico, Fresno, Stockton and San Jose, Calif., and Reno, Nevada. The products delivered through the North Line come from refineries in the San Francisco Bay Area and from various pipeline and marine terminals. SFPP also includes the San Diego Line, a 135-mile pipeline serving major population areas in Orange County and San Diego, the Oregon Line, which is a 114-mile pipeline transporting products to Eugene, Oregon for shippers from marine terminals in Portland, Oregon, the West Line which is approximately 515 miles of primary pipeline and currently transports products from the Los Angeles Basin to Phoenix, Arizona, and the East Line which is approximately 400 miles of pipeline originating in El Paso, Texas transporting products to Tucson and Phoenix, Arizona.
In addition, Kinder Morgan’s SFPP operations include 13 truck-loading terminals which provide services including short-term product storage, truck loading, vapor handling, additive injection, dye injection and oxygenate blending.

A fireball several stories high roared out of the ground near downtown Walnut Creek on Tuesday, killing two construction workers, injuring six and leaving two workers missing after a crew accidentally cut an underground jet fuel line. The blast occurred about a quarter-mile away from the intersection of Newell Avenue and South Broadway, where two crews contracted by Mountain Cascade Inc. of Livermore were installing a large water main for the East Bay Municipal Utility District. One group of workers was welding in a trench, and a second group was digging another trench with a backhoe that apparently broke a pipeline that carries aviation fuel from Concord to the San Jose International Airport, said EBMUD spokesman Charles Hardyand Walnut Creek police investigating the accident.

Ellen Sabaduquia, 54, of Walnut Creek was driving on Broadway at 1:30 p.m. when the inferno shot out of the ground a few feet from her Toyota minivan. She watched in horror as two screaming men emerged from the hole, engulfed in flames. "I thought I was in Fallujah for a moment," Sabaduquia told The Chronicle, her voice trembling. "It almost looked like slow motion from a horror movie." Sabaduquia said she wanted to get out and pick up the workers, but the flames were too ferocious and she was forced to throw her vehicle into reverse. The six workers who were injured were all burned -- three critically, authorities said.
Those with the worst injuries were airlifted to Doctors Medical Center in San Pablo in critical condition with burns over 40 to 60 percent of their bodies, said hospital spokeswoman Paula Ferron. Two victims were airlifted to John Muir Medical Center in Walnut Creek with burns so severe they were transported again to a burn center at UC Davis, according to a hospital spokeswoman. There was no information available on the sixth burn victim.
Initial reports by authorities had three workers dead, but later in the evening police said that they had confirmed two fatalities and retrieved the bodies of those victims. Authorities did not disclose the names of the dead or the missing. The accident sparked a series of underground explosions, sent a huge column of black smoke into the sky, burned one home and damaged several others on Doris Avenue, and prompted the evacuations of Las Lomas High School and Muirwood Elementary. "This is the worst day of my life," said Bill Williams of Mountain Cascade, general contractor for EBMUD's $180 million Walnut Creek-San Ramon Valley Improvement Project to increase water flow in the area.
Williams fielded phone calls Tuesday afternoon from worried wives and scanned work rosters to try to figure out who was unaccounted for. The explosion rattled shops at nearby Broadway Plaza and caused students to jump in their seats.
The force was so intense it blew out the windows of several apartments on Creekside Drive across the street and charred the cab of an 18-wheeler parked near the construction site. Initially, firefighters were prevented from approaching the searing hot flames, so they were forced to keep the public away and wait for the gasoline to burn out. Firefighters capped the pipeline at cutoff valves in Concord and Alamo, and the inferno receded about 90 minutes later, said Steve Maiero, battalion chief of the Contra Costa Fire Protection District.
They discovered two bodies in or near the hole, Maiero said. The jet fuel line, owned by Kinder Morgan Energy Partners of Houston, was marked on maps that construction workers were using, according to Eugene Braithwaite, director of operations for the company's northern region.
Kinder Morgan is under investigation in a separate incident in which 85,000 gallons of fuel spilled from one of its pipelines into the Suisun Marsh last April. Braithwaite said as soon as it was safe, Kinder Morgan would assess how to clean up the Walnut Creek pipe break, possibly using vacuum pumps to remove any residual fuel. A few Doris Avenue residents spent the night with friends or in hotels with help from the Red Cross. Among them were Enos and Leto Chabot, who lost the back half of their two-story home at 2053 Doris Ave. The fireball rose 90 feet from the construction pit, up a concrete wall and burned their entire backyard, melting the windows on their back wall. The couple were having lunch at the Hick'ry Pit restaurant nearby when they heard the boom, and they returned home to find their neighbors evacuated to a street corner a few blocks away. "The important thing is we're OK," said Leto Chabot. "We have insurance, but this will take months to get fixed." At Las Lomas High, Sarah Jones, 16, said she was in her physics class when she heard what she thought was someone dropping something on the roof.
Students were instructed over the loudspeaker to stay inside, then told to evacuate to Civic Park. They could see the plume of black smoke from the parking lot. "I don't think we were so much scared as confused," Jones said. "Because nobody told us what was going on."
 The evacuation went smoothly, however, because nearly all the students had cell phones and could call their parents to come get them. Only about 50 of the school's 1,700 students made it to Civic Park, and the rest went to downtown coffee shops and juice bars to wait for their parents. As darkness fell, authorities used a robot to shoot close-up photographs of the accident scene.

The Mysterious Death Of An Enron Exec

It may be the biggest outstanding mystery in the Enron story: the death of Cliff Baxter, a former top Enron executive. He'd just agreed to testify to Congress in the Enron case. A congressional source tells CBS News that Baxter wasn't a target in the probe, he was to provide evidence against others.

But on the morning of January 25th he was found in his car - shot dead.

Police were criticized for calling it a suicide before investigating, so they kept the case open. The fact that it's still open more than two months later has made the Cliff Baxter case prime fodder for murder conspiracy theories, reports CBS News Correspondent Sharyl Attkisson.

Adding to the mystery is a letter - perhaps a suicide note - that Baxter's wife is fighting to keep private. Groups like the Texas Freedom of Information Foundation want at least part of it made public.

"I believe very strongly that Enron is mentioned in it," said Joel White, the group's attorney.

More questions are raised in police, autopsy and lab reports obtained by CBS News.

Police won't talk while the case is open, so CBS News asked two experts - independent coroner Cyril Wecht and former homicide detective Bill Wagner - to review the reports. While suicide appears likely, both experts say the documents make it impossible to discount foul play.

Asked why he couldn't rule out murder, Wagner said, "because murder can be made to look like a suicide. ... Someone who is knowledgeable about forensics can very well have the ability to stage a murder, commit a murder and stage it to look as if it was a suicide, understanding what the police are going to be looking for."

The experts found several things highly unusual. First the peculiar ammunition: not regular bullets but something called "rat-shot".

"This kind of ammunition cannot be easily or readily traced back to the gun from which it was fired," explained Wecht.

"It's not as frequently used by people for any reason. It's not the type of ammunition one finds in guns - it has a specific purpose: shooting at snakes and rodents in order to get a distribution pattern of the small pellets contained within the nose portion of the bullet. It's not something that a person is likely to have and to use if they intended to kill themselves," said Wecht.

Other unanswered questions include mysterious wounds on one hand and unexplained shards of glass in Baxter's shirt. All reasons to look deeper to rule out murder.

But Wagner says glaring police errors may make it harder to close the books on the Baxter case.

First, nobody wrapped the hands to preserve evidence.

"When the body did finally arrive for the autopsy, the hands hadn't even been bagged," said Wagner.

"I'm just amazed frankly that the hands were not bagged," Wecht said.

"From what I've seen looking at the vehicle, it doesn't appear they even fingerprinted it," continued Wagner.

"The police narrative is vague for this type of investigation. It's important to get a timeline of the events that took place through the course of investigation - that appears to be lacking in the original report from the crime scene. Without that, without being able to piece together what was done when, it's very difficult to understand the events that took place and how they unfolded from that report," said Wagner.

The gun and other evidence were moved before photos were taken. The body was moved as well. There's a puzzling mention of blood outside the car from someone laying Baxter on the ground.

Wagner says that only should have happened if rescuers pulled him out to revive him. But even that scenario doesn't add up - the body is back in the car when the funeral home arrives "and that's something that is not explained in the police reports," said Wagner.

"I think there were some very important things omitted from the original investigation report that should have been included in it. I would like to have known what were the first couple things the Fire Department did to treat the victim allegedly as he was sitting in the car and from that point how did they change the initial crime scene. What was moved? Did they remove the body from the vehicle? It's actually unclear how they treated the actual scene," Wagner said.

Incredibly, even though an autopsy is required by law, none was ordered. By the time that decision was reversed, Baxter's body was being processed at a funeral home.

The coroner says police still won't tell her exactly who handled and who saw the body before it finally reached her and won't even give her routine information.

The official finding on Baxter's death may well end up being suicide, but for now his death certificate remains unsigned. And at least one provocative question is left permanently unanswered: what, exactly, Cliff Baxter would have told investigators about the biggest corporate scandal in history.

Fremont Group's Connection to Bin Laden and Bennett v. Southern Pacific

Back when Americans were still debating whether there was just cause for a preëmptive strike against Iraq, few arguments were scrutinized more closely than the Bush Administration’s contention that there were covert links between Al Qaeda and Iraq. At the C.I.A., analysts pored over aerial satellite photographs. At the Treasury Department, experts sifted through financial records. At the National Security Agency, Arab-speaking linguists eavesdropped on phone conversations. But, even after Secretary of State Colin Powell put his credibility on the line, in a damning, dot-connecting speech before the United Nations last February, questions persisted about the solidity of the alleged links between Saddam and Osama.

Now there is a new and demonstrable connection, but it is not the kind that the Bush Administration had in mind. In fact, it is more likely to fuel the speculations of conspiracy theorists than it is to put their fears to rest. It turns out that a money trail runs—albeit rather circuitously—from the lucrative business of rebuilding Iraq to the fortune behind Osama bin Laden. Bin Laden’s estranged family, a sprawling, extraordinarily wealthy Saudi Arabian dynasty, is a substantial investor in a private equity firm founded by the Bechtel Group of San Francisco. Bechtel is also the global construction and engineering company to which the U.S. government recently awarded the first major multimillion-dollar contract to reconstruct war-ravaged Iraq. In a closed competitive bidding process, the United States Agency for International Development chose Bechtel to rebuild the major elements of Iraq’s infrastructure, including its roads, railroads, airports, hospitals, and schools, and its water and electrical systems. In the first phase of the contract, the U.S. government will pay Bechtel nearly thirty-five million dollars, but experts say that the cost is likely to reach six hundred and eighty million during the next year and a half.
    
When the contract was awarded, two weeks ago, the Administration did not mention that the bin Laden family has an ongoing relationship with Bechtel. The bin Ladens have a ten-million-dollar stake in the Fremont Group, a San Francisco-based company formerly called Bechtel Investments, which was until 1986 a subsidiary of Bechtel. The Fremont Group’s Web site, which makes no mention of the bin Ladens, notes that "though now independent, Fremont enjoys a close relationship with Bechtel." A spokeswoman for the company confirmed that Fremont’s "majority ownership is the Bechtel family." And a list of the corporate board of directors shows substantial overlap. Five of Fremont’s eight directors are also directors of Bechtel. One Fremont director, Riley Bechtel, is the chairman and chief executive officer of the Bechtel Group, and is a member of the Bush Administration: he was appointed this year to serve on the President’s Export Council. In addition, George Shultz, the Secretary of State in the Reagan Administration, serves as a director both of Fremont and of the Bechtel Group, where he once was president and still is listed as senior counsellor.

Rick Kopf, the general counsel of the Fremont Group, which manages some eleven billion dollars in assets, confirms that the bin Laden family invested about ten million dollars in one of Fremont’s private funds before September 11, 2001. He noted that the bin Laden family has not enlarged its stake since then, but he declined to provide additional details about its association with the firm. He also chose not to discuss the origin or the nature of the relationship between the bin Laden and Bechtel families, both of which made fortunes in huge construction projects in the Arab world. The Fremont Group evidently does not go in for connecting the dots. As Kopf said, "Ownership is private and is not disclosed."

I can talk freely about events as I lost over 1M via Bennett v. Southern Pacific in 1990, it was Rick Kopf's tactics that cost me part of my hand.  I have all the room to talk about former Safeway CEO Steve Burd on several levels, my Pittsburg Safeway Manager friend was murdered in 1998 but then during my research my Safeway contracts were pulled forcing hardship on my Cabinet Shop, when my trailer flipped those contracts taken by Mormons from Alamo 1st Alamo CA.

Today, based on events at SBC, the wide spread damage to AT&Ts system and how the Exchanges around the globe were crashing a week after 9/11 but the turning point was the WTC 7 controlled demolition, knowing my friend Alicia was murdered in 2005, then discovering her connection to another 2004 Explosion in Walnut Creek that killed five and realizing it lead straight the former ENRON Story and how the 48 Story Building destroyed the investigation at the SEC which was coincidently WTC 7.

Domestic Terrorism in the East Bay 11th Congressional District

Walnut Creek CA:  On July 20th 2011 my car was totaled in Lafayette CA by persons suspected to have connections with Contra Costa County Narcotics Taskforce (CNET Scandal) who is connected to Gary Vinson Collins who is the now deceased Danville Building Inspector who is now deceased.

For brevity
Bennett has endured during 2004

  • June ~ 1996 Ford Explorer ABS System sabotaged 
  • July ~ Forced to close cabinet shop over shop equipment vandalism 
  • Aug~ Arson victim in August,
  • Sept ~ Town of Danville Sponsored mugging in
  • Oct ~ Right after assault Chris Butler arrives, 
  • San Ramon Police officer Lombardi aims weapon at Bennett, then Danville start the ticket campaign that Judge Golub eventually converts to $15,000 in fines, then there was the Nov 2004 Pipeline Explosion then I meet Alicia Driscoll, then my next door neighbor is allegedly hurt in a school bus accident on Lilac Drive Walnut Creek then my sons and I were targeted in a high speed maneuver known as a swoop and squat.


There is no brevity to my story it's an insane story but in June 2005 Alicia Driscoll died in a murder suicide, an investigation personally feel is flawed as the Alicia I'd see at McDonald's was loving mom and given Judith Williams lived a few doors away in killed her son on Mt. Diablo it doesn't look quite right.

CONGRESSMAN DeSaulnier and the Rusty Bolts Installers 

The bigger question leads back to why this blog exists as the November 9th 2004 pipeline explosion leads back to Alicia Driscoll whose is connected to Joe Driscoll who worked for Mountain Cascade then later I find Ellen Sabudaquaria died shortly later who is the most important witness seeing two men running from the tunnel on fire. To date I cannot her name anywhere on legal proceedings.

She is probably one of the most important first person witnesses to an early example of domestic terrorism.
