Luxury homes on auction block to help pay FTC penalty

One is a 14-room Monmouth Beach property with panoramic views of the Atlantic Ocean, while the other is a stately manor in Warren Township situated atop three acres of lush, manicured greenery.
But these are not the fire sales that have become routine in a down real estate market. The homes are being liquidated by the U.S. Federal Trade Commission to help pay a record $18.8 million in fines leveled against the two executives.
The settlement brought to an end a long-running scheme that duped millions of consumers in telephone fundraising campaigns carried out on behalf of nonprofit groups.
Both homes will be auctioned at 1 p.m. Sunday at the Sheraton Edison Hotel at Raritan Center. There is no minimum bid for either property, although the Monmouth Beach home was recently listed for $3.8 million.
Scott Pasch and David Keezer, partners in a firm called Civic Development Group, agreed to the fine to settle charges that they misled consumers into believing they were giving directly to charities serving police, firefighters and veterans.
Pasch and Keezer then siphoned those donations from the groups that were counting on them, authorities said.
It is the largest payout ever in an FTC consumer protection case.
Both men were required to fund a portion of the fine by turning over the two properties, bank accounts, luxury cars and boats, an art collection that included a Picasso and Van Gogh and other pricey assets. Court-appointed receiver Richard Trenk, a West Orange lawyer, has collected about $10 million in liquidated assets so far.
"These homes are the cornerstone of this liquidation and we invite anyone who has the resources to bid on these properties," he said.
The Monmouth Beach home — where Keezer lived with his wife and young children — is a hedge-lined, 12,000-square-foot structure at 88 Ocean Ave.
It is fully furnished and has five bedrooms, including a master suite with a 1,500-square-foot closet that can house "a shoe collection to rival Imelda Marcos," said Charles Blau, president of the real estate auction firm Blau Appraisal. Other features include a private beach, pool and poolside cabana.
Pasch’s 10,000-square-foot home is located at 7 Kensington Court in Warren.
The 16-room stone mansion was built on 2.8 acres of land with terraces overlooking an English garden and natural pond.
It has six bedrooms, a climate-controlled wine cellar and two gourmet kitchens.
"These homes are in pristine condition and we believe there will be spirited bidding on the 27th," he said, adding he has fielded several phone calls from interested bidders and at least 50 people have toured the homes so far.
The highest bids on the homes are subject to Trenk’s approval.

Commission Charges Bay Area Judge With Interfering in Son’s Case

The Commission on Judicial Performance has charged a Contra Costa Superior Court judge with interfering in a case involving the judge’s son.
In a notice of formal proceedings, made public yesterday, the commission said Judge Bruce C. Mills has been accused of willful misconduct, conduct prejudicial to the administration of justice, and improper action, charges that could result in his removal from the bench.
The allegations stem from the issuance of a citation for possession of tobacco to Mills’ minor son in October 2010. The commission explained in the notice that the case was assigned to Commissioner Joel Golub, and Mills’ son appeared before Golub in March of last year, pled guilty to an infraction, and ordered him to do 20 hours of volunteer work. 
Both Golub and Mills sit in Walnut Creek. (Traffic Court Fines) The judge’s son was enrolled in a residential treatment program and did not complete the volunteer work, the commission said, and was ordered to appear before Golub in October of last year. 
Conversation With Clerk
The commission accused Mills of initiating a conversation with Golub’s clerk, in which the judge allegedly asked the clerk to call his son’s case early so that the son’s attorney would not have to wait. 
“You told the clerk you wanted your son to get credit for the time spent in the program, and showed her documents reflecting payments made to the program provider,” the commission said in the notice. “The clerk told you or confirmed to you that Commissioner Golub was absent and that the calendar was being handled by a judge pro tern.”
The judge, the CJP alleged, subsequently told the clerk that the attorney was unable to appear, and that he would be appearing instead. 
The commission further alleged:
“The clerk either knew that you had a 1:30 p.m. calendar or asked if you did, and raised the idea that you could possibly speak to the judge pro tem before the afternoon calendar...was called. You indicated that you would like to do so.
“You then spoke to the judge pro tem in her chambers about your son’s case, off the record, before she called the afternoon calendar. You told the judge pro tem that your son was in a program out of state and that you wanted him to receive credit toward the volunteer work requirement for being in the residential program. After questioning you about the program, the judge pro tem agreed to grant your request. No proceedings were conducted in open court on your son’s case.”
Canons of Ethics
By that conduct, the commission alleged, Mills violated canons of ethics requiring that judges uphold the integrity of the judiciary; avoid impropriety and promote public confidence; refrain from using the prestige of the judiciary to advance private interests; and avoid ex parte communications, other than in specified situations.
The judge’s formal response to the charges is due Nov. 20, the commission said. Mills’ attorney, James A. Murphy of San Francisco, could not be reached for comment.
Mills, a 1984 graduate of Lewis and Clark Law School in Oregon, practiced at a Walnut Creek firm until 1986, and was a deputy district attorney for Contra Costa County from 1987 until 1995, when he was appointed to the Walnut Creek-Danville Municipal Court by then-Gov. Pete Wilson. He became a Contra Costa Superior Court judge through unification in 1998. 
He was publicly admonished by the commission in 2006 for having improper ex parte discussions with a defendant, a lawyer, and a probation officer and for making inappropriate remarks from the bench. 
The commission found that Mills had, among other things, made “sarcastic and discourteous” remarks regarding a defendant whom the judge believed was faking an inability to speak English. 
“Judge Mills has engaged in a pattern of making comments that are discourteous, sarcastic, demeaning and belittling to those appearing before him,” the commission said at the time. “Such remarks toward a litigant or counsel are not consistent with the conduct required by canon 3B(4),” requiring that judges conduct their official duties in a patient and dignified manner. 
The commission also found that in 1997, Mills had improperly granted diversion after chambers discussions involving the defense lawyer, the defendant, and the probation officer—who had originally suggested that the defendant was ineligible—after the defendant’s no contest plea had been accepted and the prosecutors had left the courthouse.

NEW YORK (CNN/Money) - The Bush administration launched a war on terror because of the alleged acts of Osama bin Laden. Ironically, one of the companies the administration has picked to rebuild Iraq after the latest phase of that war has ties to bin Laden's family, according to a published report.
Bechtel Corp., a private construction firm based in San Francisco, recently was awarded a State Department contract, potentially worth more than $600 million, to help rebuild Iraq's infrastructure after the recent U.S.-led war there.
The Bush administration pushed for that war, in part, because it said the regime of Saddam Hussein, former leader of Iraq, had ties to the al Qaeda terror network, headed by bin Laden, the group allegedly responsible for the Sept. 11, 2001, terrorist attacks in the United States.
According to an article in the May 5 issue of New Yorker magazine, several bin Laden family members -- part of a large, Saudi Arabian family that made a fortune in the construction business -- invested about $10 million in a private equity fund operated by former subsidiary of Bechtel before Sept. 11.
Fremont Group, a San Francisco-based private investment firm, once was a unit of Bechtel, and its board still includes Bechtel CEO Riley P. Bechtel and former U.S. Secretary of State and former Bechtel President George P. Shultz, along with several current Bechtel directors.
Bechtel could not be reached for comment.
Fremont spokeswoman Pat Harden confirmed bin Laden's family had invested $10 million in a Fremont fund, but she said the family had no ownership stake in Fremont and its investment was made "well before the events of Sept. 11."
"Our concern is that it be clear they're investors, like many, in one of our many private equity funds," Harden said, noting that the Patriot Act of 2001 requires such investors to be screened for connections to terrorism. "This is all totally legal and above-board."
Harden didn't know exactly when bin Laden's family invested in the equity fund. Fremont general counsel Rick Kopf told the New Yorker bin Laden's family had invested nothing in Fremont since Sept. 11.
None of bin Laden's family members has been charged with any crimes, and the family denounced Osama bin Laden in the mid-1990s. Some family members also have publicly denounced the Sept. 11 attacks.
Saying they feared for their safety, about two dozen family members living in the United States left the country as soon as airports re-opened after Sept. 11.  Top of page

In January 2011 a PG&E Certified Vendor initiated a contact call for my programming services.  At the time I was actually homeless. The events that created the homelessness are specific to a Police Corruption Scandal locally known as the CNET Scandal.  

In 2004 I was living in Danville when everything around me spun out of control.  A divorce, hit and run, accidents, clients threatened and one very strange truck fire where Police and Fire all stated it wasn't arson.  

During the PG&E engagement several events occurred that should be of utmost concern to PG&E.

  • PG&E Kidnapping - Walnut Creek 
  • PG&E High Performance Engineer in my offices

 What PG&E doesn't know about is my attorneys offices burned down in 2001 via arson the FBI investigate as I didn't waste time with Local Police. Last week Chief Chaplin provided me with years of police reports being stalled by the former regime, at another agency there are 20 false reports, with others there are another 100 reports.

Whoever is behind these events are connected to your explosion, to several arson fires near me and numerous deaths.

The  #pgedatabreach via a theft of my laptop filled with PG&E Data by your MBE Vendor falls into extremely dangerous territory.  My review of the files revealed maps to the Metcalf Attack.

The Brian Cherry letter was accurate and recently I've linked one again persons near your organization lead backwards to my truck arson, assault cases and from my perspective.

Starting in 2004, Former Superior Court Judge Joel Golub laid down over $15,000 in fines but here again one a former PG&E Senior Counsel Howard Golub of Nixon-Peabody is yet another PG&E connection where the San Ramon Valley School district filed orders on me all lead to the officers on this page.  

Seems like the Golub's failed in many ways and their obstruction of justice and interference with lawful court orders. 

Today we're going ask the FBI why another PG&E Employee seems to be connected to me.  In 2004 Judge Golub was well aware of my 2004 Truck Arson, a 2011 Hit and run that breached your databases and after nearly four years with CHP Threat Assessment Unit the murders near multiple incidents are far too many year.

In my opinion CHP is under pressure to coverup events and more than one agency has lost officers near my events.  I shared the PG&E and Truck Arson Story with Officer Youngstrom and months later he was dead.

Walnut Creek CA: I've called Consolidated Fire, drove to their offices, wrote letters and called the CHP Unit in Sacramento with details about stonewalling.

Connections

My attorney was Donald Gene Moats who represented me in 2001 but my case was derailed by this fire.  My losses - about 100K as Moats never appeared in court and the case went down the drain quickly. He was disbarred shortly thereafter but I'm wondering if a different reason was the cause.

In 2004 my F-250 Truck was set ablaze on 680 - in 2004 Judge Golub was connected my former family in Danville at 161 Valle Vista Danville.  I told this Judge two critical statements, One that I suspected my truck was arson, that my truck fire was the work of local residents and police officers.  Ten years later this story breaks CNET Scandal I'm being beaten by Gary Collins now Deceased.  Over the 2012/2013 winter I informed Judge Golub more than once that my truck fire was linked to the Piedmont Lumber fire and other local fires.  I suspect the San Mateo Bridge Fire is going to fall into that category.  Broken springs or air shocks - CHP has a credibility problem with me as in 2004 I tried to tell a CHP officer my truck fire was arson.

Ten years later San Ramon Fire District has Pete Amnesia but wait Consolidated Fire can't find this fire.  I've called many times and by now I'm sure my phone is under surveillance - you guys are so pathetic. One of the stalkers from Hillside Covenant Church works at Station One and is friends with the two youth directors who each share responsibility for my 2011 Car accidents. That accident was attempted murder - nothing more nothing less.

A four-alarm fire on the second floor of a Walnut Creek office building early Monday quickly spread and forced fire officials to close down all 16 suites.

 No one was injured in the blaze at 1776 Ygnacio Valley Road. The building houses legal and medical offices.

 Fifty firefighters fought the 3:16 a.m. blaze for more than two hours, said Contra Costa Fire District Battalion Chief Steve Maiero.

 "Investigators are trying to pinpoint the exact area of origin," Maiero said. "Part of the roof completely burned through and structural beams were heavily damaged."

Maiero estimated damage would exceed $1 million.

 Dr. Peter Binstock stood just steps away from his office when his patient, Ranella Elder of Antioch, walked up to him in the hours just after the fire . Elder had a 9:45 a.m. appointment.

 "It's odd," Elder said. "I come here and the building's on fire and (my doctor) is actually looking at my finger in the middle of the parking lot."

Binstock, who specializes in infectious diseases, said he wasn't worried about having to relocate.

 "Eighty to 90 percent of our patients are hospital-based," he said.

 Building owner Scot Bergren said it could take at least six months to restore the building, but he hoped a few tenants would be allowed back earlier into suites where the damage wasn't so severe.

 "It's a shame that all these poor tenants and patients are being inconvenienced," he said. "This is not a great day for anybody. We'll just make the best of it and move forward."

 Frances Wymore, a legal secretary at the law offices of Mark P. Grundman, is one of 65 people who work in the building.

 "I'm waiting for my boss to come and see if he can get us in" said Wymore, of Concord. She spent most of the afternoon in court, then purchased office supplies to replace the damaged ones inside.
