PG&E Charged With Multiple Violations Of The Natural Gas Pipeline Safety Act

SAN FRANCISCO, Calif. - On April 1, 2014, a federal grand jury for the Northern District of California returned an indictment charging Pacific Gas and Electric Company ("PG&E") with multiple violations of the Natural Gas Pipeline Safety Act of 1968 ("PSA"), announced U.S. Attorney Melinda Haag, California Attorney General Kamala D. Harris, San Mateo County District Attorney Stephen M. Wagstaffe, U.S. Department of Transportation Office of Inspector General Special Agent in Charge William Swallow, and FBI Special Agent in Charge David J. Johnson. PSA violations were uncovered in the course of an investigation initiated after the fatal San Bruno natural gas pipeline explosion in 2010.


The indictment alleges that PG&E knowingly and willfully violated the PSA and its regulations between 2003 and 2010. According to the indictment, the charges stem from PG&E's record keeping and pipeline "integrity management" practices. The indictment alleges that PG&E failed to address recordkeeping deficiencies concerning its larger natural gas pipelines knowing that their records were inaccurate or incomplete.


The indictment also alleges that PG&E failed to identify threats to its larger natural gas pipelines and that PG&E did not take appropriate actions to investigate the seriousness of threats to pipelines when they were identified. In addition, the indictment alleges that PG&E failed to adequately reprioritize and assess threatened pipelines after the pipelines were over pressurized as required by the PSA and its regulations.


"The citizens of Northern California deserve to have their utility providers put the safety of the community first," said U.S. Attorney Haag. "Today's indictment of PG&E for violating the minimum safety standards established by the Natural Gas Pipeline Safety Act reflects the company's failure to follow that very basic principle. This investigation is the result of strong collaboration among federal, state, and local law enforcement authorities, the California Attorney General's Office, and the San Mateo County District Attorney's Office. I look forward to continuing to work closely with these partners in our efforts to hold PG&E accountable for their disregard for the safety of our community."


"Today's indictment is an important step in providing justice for the individuals, families and community devastated by the 2010 pipeline explosion and fire in San Bruno," said California Attorney General Kamala D. Harris. "As alleged in the indictment, PG&E knowingly and willfully failed to identify and evaluate threats to its transmission pipelines, including Line 132 underneath much of San Bruno. When allegedly faced with evidence of transmission line problems, PG&E knowingly and willfully chose not to assess and remediate the problems. My office will continue our work with local and federal partners in prosecuting this matter in federal court and holding PG&E accountable for its alleged conduct."


"The indictment returned by the Grand Jury is an important step in holding PG&E criminally responsible for their willful misconduct," said San Mateo County District Attorney Stephen M. Wagstaffe. "The San Bruno Police Department and my office will continue to support and work closely with the offices of the United States Attorney and the California Attorney General to bring PG&E to justice."

"The Federal Pipeline Safety Act is designed to guard against risks to life or property in the course of distributing goods and services to entrusting consumers," said FBI Special Agent in Charge David J. Johnson of the San Francisco Field Office. "This office has the responsibility not only to uphold and enforce the criminal laws of the United States but also to do everything we can to protect the public. The charges alleged in this indictment should be symbolic of the FBI's commitment to serving justice no matter how long it takes."


PG&E is charged with 12 separate violations of the PSA. The maximum statutory penalty for each count for a corporation is $500,000 or a fine based on the gain the corporation made as a result of the violation or the loss caused to victims.


An indictment merely alleges that crimes have been committed, and the defendant is presumed innocent until proven guilty beyond a reasonable doubt.


The prosecution is the result of a three-year investigation conducted by the U.S. Attorney's Office for the Northern District of California, the California Attorney General's Office, the San Mateo County District Attorney's Office, the United States Department of Transportation Office of Inspector General, the FBI, the Pipeline and Hazardous Material Safety Administration, and the city of San Bruno Police Department.

SAN FRANCISCO - A federal grand jury for the Northern District of California returned a superseding indictment charging Pacific Gas and Electric Company (PG&E) with obstruction of the investigation of the National Transportation Safety Board ("NTSB"), as well as additional violations of the Natural Gas Pipeline Safety Act of 1968 (PSA), announced U.S. Attorney Melinda Haag, California Attorney General Kamala D. Harris, San Mateo County District Attorney Stephen M. Wagstaffe, U.S. Department of Transportation Office of Inspector General Special Agent in Charge William Swallow, and FBI Special Agent in Charge David J. Johnson.




The superseding indictment alleges that PG&E obstructed the NTSB's investigation that began immediately after the deadly San Bruno explosion. According to the superseding indictment, during the course of the NTSB's investigation, PG&E provided a version of a policy outlining the way in which PG&E addressed manufacturing threats on its pipelines. PG&E later withdrew that policy claiming it was produced in error, and was an unapproved draft. In fact, PG&E was operating under the so-called unapproved draft from 2009 through April 5, 2011. The consequence of this practice was that PG&E did not prioritize as high-risk, and properly assess, many of its oldest natural gas pipelines, which ran through urban and residential areas.

Additionally, the superseding indictment charges PG&E with 27 counts of knowingly and willfully violating the PSA. These charges stem from PG&E's record keeping and pipeline "integrity management" practices. The superseding indictment alleges that PG&E failed to address recordkeeping deficiencies concerning its larger natural gas pipelines knowing that their records were inaccurate or incomplete. The superseding indictment also alleges that PG&E failed to identify threats to its larger natural gas pipelines and that PG&E did not take appropriate actions to investigate the seriousness of threats to pipelines when they were identified. Finally, the superseding indictment alleges that PG&E failed to adequately reprioritize and assess threatened pipelines after the pipelines were over pressurized as required by the PSA and its regulations.

PG&E is charged with one count of obstruction of an agency proceeding in violation of 18 U.S.C. §1505, and 27 separate counts of violations of the PSA. The maximum statutory penalty for each count is a $500,000 fine or a fine based on the twice the gross gain PG&E made as a result of the violations, or twice the losses suffered by the victims. The superseding indictment alleges that PG&E derived gross gains of $281 million, and victims suffered losses of approximately $565 million. PG&E is next scheduled to appear on August 18, 2014 before the Honorable Thelton E. Henderson, United States District Judge.




Kim A. Berger and Hallie M. Hoffman are the Assistant U.S. Attorneys who are prosecuting the case, with the assistance of Alycee Lane and Pat Mahoney, along with Deputy Attorneys General Brett Morris and Deborah Halberstadt from the California Attorney General's Office. The prosecution is the result of an investigation conducted by the San Mateo County District Attorney's Office, the United States Department of Transportation Office of Inspector General, the FBI, the Pipeline and Hazardous Material Safety Administration, and the city of San Bruno Police Department.

Please note, an indictment contains only allegations and, as with all defendants, PG&E must be presumed innocent unless and until proven guilty.

Associated PressA federal grand jury charged Pacific Gas & Electric on Tuesday with lying to federal investigators in connection with a fatal pipeline explosion that killed eight people and leveled a suburban Northern California neighborhood in 2010.
The U.S. attorney in San Francisco announced the obstruction of justice charge and 27 related counts, which are in a new indictment charging the utility with felonies. It replaces a previous indictment that contained 12 counts related to PG&E's safety practices, but not obstruction.
Prosecutors say PG&E hampered the investigation by lying to National Transportation Safety Board investigators after the blast. In particular, PG&E officials are accused of trying to mislead the NTSB about the pipeline testing and maintenance procedures the utility was following at the time of the explosion and for six months after under a company policy that did not meet federal safety standards.
"The consequence of this practice was that PG&E did not prioritize as high-risk, and properly assess, many of its oldest natural gas pipelines, which ran through urban and residential areas," the U.S. attorney's office said in a statement.
The other charges accuse the utility of failing to act on threats in its pipeline system even after the problems were identified by its own inspectors. The indictment charges PG&E with keeping shoddy records, failing to identify safety threats and failing to act when threats were found.
NTSB investigators later found that PG&E had inaccurate records on its more than 6,000 miles of gas transmission lines, and that as a result hadn't tested for the defective seam weld that ruptured a pipeline and ignited the fireball that leveled several blocks and left eight people dead in San Bruno.
No employees or executives have been charged in the San Bruno disaster. Prosecutors could still file another indictment charging individuals.
The utility announced in June that it was expecting the new indictment. PG&E spokesman Greg Snapper said company officials had not yet seen it.
"However, based on all of the evidence we have seen to date, we do not believe that the charges are warranted and that, even where mistakes were made, employees were acting in good faith to provide customers with safe and reliable energy," he said in a prepared statement.
The new charges expose PG&E to more than $1 billion in fines. It had preciously faced up to a $6 million fine under the old indictment.
In addition, the utility is facing lawsuits and $2.5 billion in civil fines from regulators, including the state Public Utilities Commission. San Bruno city officials on Monday demanded the head of the PUC resign, alleging the agency had improper contacts with PG&E.
Along with causing the deaths, the explosion injured dozens and destroyed 38 homes. Nearly four years later, the neighborhood about 12 miles south of San Francisco is still recovering.
"What the U.S. prosecutor is saying is that PG&E did not use the proper procedure under the law for evaluating the integrity of their pipelines," San Bruno City Manager Connie Jackson said. "On top of that, they represented to NTSB that the procedure they were using was correct and approved" when it wasn't.
On Tuesday, San Bruno Mayor Jim Ruane said "the new criminal charges demonstrate a pattern of deceit by PG&E."
PG&E said in May that it has committed $2.7 billion over the next several years for safety-related work following the incident.
Its profits were weighed down in its most recent quarter by $40 million in legal and safety improvement costs tied to its natural gas business.

I am writing to express my concerns over the handling of my complaints in regards to following events related to payments or lack of, several hit and runs targeting this former PG&E vendor and related information connecting the 2004 Kinder Morgan Fire in Walnut Creek CA, several fires in Walnut Creek, the kidnapping of a PG&E Employee working in the same building Wiget address where project meetings were held and the near pathetic indifferent response from PG&E security, the legal department, outside legal counsel Attorney Kate Dyer and internal PG&E resources who've been fully informed about the many attempts on my life since being contracted to PG&E post explosion efforts.

Paying Your Vendors (me) vs. Leaving me to be hit by cars 

Around 9:00 AM today (7/26/14) another attempt was made to hit me in a crosswalk.  Last year my roommate was mugged resulting in severe head injury, my other roommate was David Bremer was murdered somewhere between Walnut Creek to Martinez Detention Facility (MDF)) where he was beaten to death.

He was a nice kid sad story here in Contra Costa County where we should really call this place Cold Case County as we have blacks hanging from trees back in the 80s, where little old Japanese Ladies (Fake Tip Line) burn to death on remote road,  where the Town of Lafayette Chief Christiansen refused to investigate my July 20th, 2011 accident but lest not forget I was nearly killed while working on the deadliest gas pipeline explosion in the country.

PG&E's Failure to Address Complaints 
On July 20th 2011 my car was totaled enroute to Lafayette CA from Walnut Creek.  At the time I was contracted to PG&E where unknowingly possessed thousands of pages of maps, GPS, sensitive internal documents, litigation sensitive files, and was essentially by definition facing criminal imprisonment over Child Support a problem developed over issues related to persons now in Federal Prison

I'm also betting they are now key suspects in many primarily East Bay arson fires which in brief several are highlighted below

    Arson Network 

    A decade of deceit, obfuscations of investigations over decades, hundreds of failed calls to elected officials, with nearly 100 police reports in certain cities it's clear as ever that the failed 2004 Arson Investigation on 680 was the work of more than one Danville CA Police Officer who presented himself as a CHP officer but was riding a BMW, that this arsonist is still employed with the Contra Costa County Sherriff's office, that near fatal fires are the work of the same arson network in play for decades.

    In fall 2011 that same in Danville who impersonated a CHP officer in two separate incidents.  This failed investigation also straddles a long list of suspicious fires, gas pipeline explosions, deadly fires, obvious arson incidents with numerous connections to several plane crashes, car accidents and suspicious deaths falling into several characteristics of untimely, accidental or deliberate.

    There are many types of Modus Operandi in play but 

    The Failed Bennett Arson Investigation:

    • Murders Near Attorneys, Real Estate
