Domestic Terrorism Breach - Historical Breaches of Bennett's PG&E Laptop

Once upon a time there was a fine country with happy citizens but inside there was a Dark Fairy with unbridled power, greed and contempt.  Every Dark Fairy had a Political Fairy who was favored in all the courts, the courts of men, the courts of heaven, the courts of California.   Their sole existence in the fairy world was to deny and denying everything.

The political fairies are the charming ones, always clever, always connected tending to hide paperwork under rugs from the meanest of regulators or in my story they hired unsuspecting programmers to hide things for them as nobody would know.

The Dark Fairy's were so good at lying they'd lied to all that came before them.

EBRC Vandals Topple East Bay Radio Tower



Vandals Topple Tower while you were sleeping 

Tuesday, Jul 30, 2013 • Updated at 11:50 AM PDT

A massive communications tower on East Bay Regional Park District property collapsed over the weekend, prompting park police to seek the vandals who likely toppled it.

Lt. Jon King said despite the tower falling on its side on the Rocky Ridge, west of San Ramon and Danville, sometime before Monday morning, no one was injured and all systems remained operational because the communication systems are built with backups.

King did not say exactly when the tower fell over.

Police were alerted to the problem about 9 a.m. on Monday.

Officers responded and found that the cables that hold the tower in place had been cut, causing it to fall, police Capt. Mark Ruppenthal told Bay City News.

The tower supports radio communications systems, including public safety communications, across the East Bay.

Investigators are trying to determine why vandals would target the tower, which is located in a remote area of the park behind multiple gates and fences. "It's not easily accessed," he said.

It’s unclear if this communications tower toppling is related to what’s been going on in the South Bay.

In April, the PG&E substation in South San Jose was vandalized, most likely by gunfire, shutting down 911 systems for much of the day.

And in May, a suspicious man in black was seen casing the property, according to the Santa Clara County Sheriff.

$1.4 billion penalty urged for PG&E in San Bruno blast

Pacific Gas and Electric Co. must pay a record $1.4 billion in fines and improvements for violating pipeline safety laws in the deadly San Bruno natural-gas explosion, two administrative law judges said Tuesday.
The California Public Utilities Commission judges levied a $950 million fine against PG&E for the September 2010 blast that killed eight people and destroyed 38 homes. They also ordered the company to pay $400 million in improvements to its pipeline transmission system and $50 million in other costs, including an audit of changes it has already made to its gas lines since the disaster.
Combined with $635 million in pipeline upgrades that PG&E has already been ordered to absorb, the total cost of San Bruno fines and improvements to the company will top $2 billion, commission officials said in a statement.
The fines and ordered improvements would be paid for by PG&E's shareholders, not the company's customers.
The judges' ruling is final unless one of the parties in the San Bruno case or one of the utilities commission's five members challenges it within 30 days. If that happens, the matter would go before the full commission, whose members are appointed by the governor.
PG&E officials issued a statement that did not say whether they would challenge the ruling.
"We are accountable and fully accept that a penalty is appropriate," the company's statement said. "We have respectfully asked that the commission ensure that the penalty is reasonable and proportionate and takes into consideration the company's investments and actions to promote safety. Moreover, we believe any penalty should directly benefit public safety."
San Bruno City Manager Connie Jackson said it was "way too soon" for city officials to decide whether to appeal.
Mayor Jim Ruane said he was concerned that the judges hadn't ordered PG&E to spend more on safety improvements, and that the penalty may be disproportionately weighted toward fines.
"There is an extraordinary amount in the fine that does not go directly into safety of the pipelines in the ground," Ruane said, "and that's unfortunate."
Investigations by the National Transportation Safety Board and a blue-ribbon panel appointed by the utilities commission have said PG&E failed to adequately test and maintain its system of more than 1,100 miles of urban gas-transmission lines before the San Bruno explosion. The blast happened when a seam weld that PG&E didn't know existed ruptured on a 30-inch transmission line.
Since the disaster, company executives say, PG&E has beefed up its pipeline replacement and testing programs and improved its emergency response system.
The penalty announced Tuesday would far exceed the utilities commission's highest-ever against a utility for gas-related violations, a $38 million fine against PG&E for a December 2008 explosion that killed a homeowner in Rancho Cordova (Sacramento County). It would also exceed the biggest fine ever against a U.S. utility for a gas blast, topping the $101.5 million fine against El Paso Natural Gas for an August 2000 explosion that killed a dozen campers in Carlsbad, N.M.
The PG&E case was divided into two main areas. Administrative Judge Amy Yip-Kikugawa presided over hearings into PG&E's incomplete or missing pipeline records and its failure to track population growth in urban areas and lower pressures accordingly for safety reasons.
Yip-Kikugawa found that PG&E had routinely made flawed assumptions about its pipelines and had known its records were in disarray. She also found the utility had consistently failed to lower pipeline pressures around newly developed areas, as required by law.
Retired Administrative Law Judge Mark Wetzell oversaw the allegations stemming from the blast itself. He found PG&E had failed to properly test many of its at-risk pipelines, including the one that ruptured in San Bruno. The company relied on an inspection method for most pipelines that was incapable of detecting flawed welds, Wetzell found.
Working off incorrect records, PG&E had concluded that the pipeline installed in San Bruno's Crestmoor neighborhood in the 1950s had no seam welds. The line finally ruptured at a cobbled-together assortment of short pipes, many with flawed seam welds.

Walnut Creek CA:  On July 20th 2011 my car was totaled in Lafayette CA by persons suspected to have connections with Contra Costa County Narcotics Taskforce (CNET Scandal) who is connected to Gary Vinson Collins who is the now deceased Danville Building Inspector who is now deceased.

There is no brevity to my story it's an insane story but in June 2005 Alicia Driscoll died in a murder suicide, an investigation personally feel is flawed as the Alicia I'd see at McDonald's was loving mom and given Judith Williams lived a few doors away in killed her son on Mt. Diablo it doesn't look quite right.

The bigger question leads back to why this blog exists as the November 9th 2004 pipeline explosion leads back to Alicia Driscoll whose is connected to Joe Driscoll who worked for Mountain Cascade then later I find Ellen Sabudaquaria died shortly later who is the most important witness seeing two men running from the tunnel on fire. To date I cannot her name anywhere on legal proceedings.

She is probably one of the most important first person witnesses to an early example of domestic terrorism.

PG&E Pleads Not Guilty! #metoo

SAN BRUNO -- PG&E pleaded not guilty Monday to a new federal criminal indictment on felony charges linked to a fatal 2010 natural gas pipeline explosion here, and hours later, San Bruno officials requested that the state Public Utilities Commission preserve computer drives and digital data that could shed light on ties between the PUC and the utility it oversees.
The city of San Bruno, where eight people were killed in the pipeline explosion, says it's concerned that key emails, texts and other electronic documents, as well as paper documents, voice mails and handwritten notes could vanish amid a current effort by the PUC to swap out hard drives on its computers.

San Francisco-based PG&E is charged with 28 federal criminal counts, including obstruction of justice for allegedly impeding an investigation into the explosion and violations of the pipeline safety act that led to the explosion.

"Not guilty to all counts," Steven Bauer, an attorney for PG&E with law firm Latham & Watkins, said at the brief proceeding Monday before a federal magistrate at the U.S. District Court in San Francisco. Individual employees of PG&E have not been charged in the case, and PG&E executives did not appear at the hearing.

Assistant U.S. Attorney Hallie Hoffman, who appeared for the federal prosecution in the proceeding, said the utility faces a fine of up to $1.13 billion if convicted.

Following the hearing, San Bruno City Manager Connie Jackson requested that federal prosecutors press for creation of a California pipeline safety trust to help improve natural gas pipes statewide, and to establish an independent monitor to oversee PG&E and the state Public Utilities Commission.

"PG&E has refused to step up and take full responsibility for the explosion," said Jackson, who expressed the city's support for the government prosecution.
San Bruno officials, in a letter to PUC Executive Director Paul Clanon, said it is essential that all electronic equipment, data and documents related to three ongoing investigations into the explosion be preserved and available for public inspection.

"Any failure to assure the preservation and protection of all paper and electronic documents related to these proceedings could form the basis of criminal or civil liability for destroying evidence or spoliation of evidence," Jackson wrote in the letter.
One of the federal criminal charges alleges that PG&E deliberately obstructed an investigation of the explosion by the National Transportation Safety Board.
Federal prosecutors also have charged PG&E with 27 alleged violations of pipeline safety rules.
"Based on all of the evidence we have seen to date and our review of the new indictment, we still do not believe that PG&E employees intentionally violated the federal Pipeline Safety Act," PG&E spokesman Greg Snapper said after the hearing. "Even where mistakes were made, employees were acting in good faith."
Separately, San Bruno pointed out that a series of emails between officials with the PUC and PG&E show a cozy relationship between the two organizations.
The latest suggestions of an improper relationship are linked to a cancelled symposium on gas safety sponsored by the state government. PG&E worked closely with the PUC on the symposium, which was canceled after San Bruno officials brought the meeting to light, calling it a "dog-and-pony show" aimed at presenting PG&E in a favorable light.
"This is appalling," Jackson said. "It was our protests that caused the cancellation of that symposium."
The symposium flap is one of numerous instances that suggest close ties between the PUC and PG&E. In some of the emails, PUC President Michael Peevey offered public relations advice to PG&E.
The emails involving the PUC have prompted numerous critics to demand Peevey's ouster.
But in a meeting last week with the editorial board of this newspaper, Gov. Jerry Brown expressed support for Peevey, describing him as "a very effective leader; he gets things done."

San Bruno says that the PUC, under Peevey's leadership, has fostered close ties with PG&E that are improper. "PG&E is pulling the strings at the PUC," Jackson said.

Identifying the 680 Arsonist leads to solving the Gas Pipeline Explosions @senfeinstein

Find the 680 Buy Scout Arsonist and you'll find Alicia Driscoll's killers

Abstract: In this article I will correlate why my 2004 Truck fire will lead to solving all the fires in Contra Costa County.  Several of these fires occurred in Rossmoor that will lead from the Limo Fire on Skycrest to the Limo Fire on the San Mateo Bridge which could lead to the deadly FedEx Truck Fire where students heading northbound Interstate 5 in preparation of attending college.

I've developed a highly plausible theory on the uncomfortable theory the real story is this was Domestic Terrorism for legal profit which is theoretically linked to my 200 Arson case and how Law Enforcement in Contra Costa County have covered up decades of arson cases as fires.

From there I will argue that the sum of these events connect to the PG&E San Bruno Explosion and the Walnut Creek Explosions.  The only two North American Gas Line Explosions that resulted in significant deaths occurred in the same geographic region but worse had the Municipal Pooling Authority, EBMUD and Contra Costa Law Enforcement had done their job then we'd know the truth about the The Dead Contra Costa Witness Program or that perhaps my efforts connected to my 2004 Truck Fire are being derailed to cover up the obvious that it was attempted murder.

SAN FRANCISCO, Calif. - On April 1, 2014, a federal grand jury for the Northern District of California returned an indictment charging Pacific Gas and Electric Company ("PG&E") with multiple violations of the Natural Gas Pipeline Safety Act of 1968 ("PSA"), announced U.S. Attorney Melinda Haag, California Attorney General Kamala D. Harris, San Mateo County District Attorney Stephen M. Wagstaffe, U.S. Department of Transportation Office of Inspector General Special Agent in Charge William Swallow, and FBI Special Agent in Charge David J. Johnson. PSA violations were uncovered in the course of an investigation initiated after the fatal San Bruno natural gas pipeline explosion in 2010.


The indictment alleges that PG&E knowingly and willfully violated the PSA and its regulations between 2003 and 2010. According to the indictment, the charges stem from PG&E's record keeping and pipeline "integrity management" practices. The indictment alleges that PG&E failed to address recordkeeping deficiencies concerning its larger natural gas pipelines knowing that their records were inaccurate or incomplete.


The indictment also alleges that PG&E failed to identify threats to its larger natural gas pipelines and that PG&E did not take appropriate actions to investigate the seriousness of threats to pipelines when they were identified. In addition, the indictment alleges that PG&E failed to adequately reprioritize and assess threatened pipelines after the pipelines were over pressurized as required by the PSA and its regulations.


"The citizens of Northern California deserve to have their utility providers put the safety of the community first," said U.S. Attorney Haag. "Today's indictment of PG&E for violating the minimum safety standards established by the Natural Gas Pipeline Safety Act reflects the company's failure to follow that very basic principle. "Today's indictment is an important step in providing justice for the individuals, families and community devastated by the 2010 pipeline explosion and fire in San Bruno," said California Attorney General Kamala D. Harris. "As alleged in the indictment, PG&E knowingly and willfully failed to identify and evaluate threats to its transmission pipelines, including Line 132 underneath much of San Bruno. When allegedly faced with evidence of transmission line problems, PG&E knowingly and willfully chose not to assess and remediate the problems. My office will continue our work with local and federal partners in prosecuting this matter in federal court and holding PG&E accountable for its alleged conduct."

"This office has the responsibility not only to uphold and enforce the criminal laws of the United States but also to do everything we can to protect the public. The charges alleged in this indictment should be symbolic of the FBI's commitment to serving justice no matter how long it takes."


PG&E is charged with 12 separate violations of the PSA. The maximum statutory penalty for each count for a corporation is $500,000 or a fine based on the gain the corporation made as a result of the violation or the loss caused to victims.


An indictment merely alleges that crimes have been committed, and the defendant is presumed innocent until proven guilty beyond a reasonable doubt.


The prosecution is the result of a three-year investigation conducted by the U.S. Attorney's Office for the Northern District of California, the California Attorney General's Office, the San Mateo County District Attorney's Office, the United States Department of Transportation Office of Inspector General, the FBI, the Pipeline and Hazardous Material Safety Administration, and the city of San Bruno Police Department.

PG&E Charged With Obstruction Of The Investigation Of The National Transportation Safety Board And Additional Violations Of The Natural Gas Pipeline Safety Act

SAN FRANCISCO - A federal grand jury for the Northern District of California returned a superseding indictment charging Pacific Gas and Electric Company (PG&E) with obstruction of the investigation of the National Transportation Safety Board ("NTSB"), as well as additional violations of the Natural Gas Pipeline Safety Act of 1968 (PSA), announced U.S. Attorney Melinda Haag, California Attorney General Kamala D. Harris, San Mateo County District Attorney Stephen M. Wagstaffe, U.S. Department of Transportation Office of Inspector General Special Agent in Charge William Swallow, and FBI Special Agent in Charge David J. Johnson.




The superseding indictment alleges that PG&E obstructed the NTSB's investigation that began immediately after the deadly San Bruno explosion. According to the superseding indictment, during the course of the NTSB's investigation, PG&E provided a version of a policy outlining the way in which PG&E addressed manufacturing threats on its pipelines. PG&E later withdrew that policy claiming it was produced in error, and was an unapproved draft. In fact, PG&E was operating under the so-called unapproved draft from 2009 through April 5, 2011. The consequence of this practice was that PG&E did not prioritize as high-risk, and properly assess, many of its oldest natural gas pipelines, which ran through urban and residential areas.

Additionally, the superseding indictment charges PG&E with 27 counts of knowingly and willfully violating the PSA. These charges stem from PG&E's record keeping and pipeline "integrity management" practices. The superseding indictment alleges that PG&E failed to address recordkeeping deficiencies concerning its larger natural gas pipelines knowing that their records were inaccurate or incomplete. The superseding indictment also alleges that PG&E failed to identify threats to its larger natural gas pipelines and that PG&E did not take appropriate actions to investigate the seriousness of threats to pipelines when they were identified. Finally, the superseding indictment alleges that PG&E failed to adequately reprioritize and assess threatened pipelines after the pipelines were over pressurized as required by the PSA and its regulations.

PG&E is charged with one count of obstruction of an agency proceeding in violation of 18 U.S.C. §1505, and 27 separate counts of violations of the PSA. The maximum statutory penalty for each count is a $500,000 fine or a fine based on the twice the gross gain PG&E made as a result of the violations, or twice the losses suffered by the victims. The superseding indictment alleges that PG&E derived gross gains of $281 million, and victims suffered losses of approximately $565 million. PG&E is next scheduled to appear on August 18, 2014 before the Honorable Thelton E. Henderson, United States District Judge.




Kim A. Berger and Hallie M. Hoffman are the Assistant U.S. Attorneys who are prosecuting the case, with the assistance of Alycee Lane and Pat Mahoney, along with Deputy Attorneys General Brett Morris and Deborah Halberstadt from the California Attorney General's Office. The prosecution is the result of an investigation conducted by the San Mateo County District Attorney's Office, the United States Department of Transportation Office of Inspector General, the FBI, the Pipeline and Hazardous Material Safety Administration, and the city of San Bruno Police Department.
